1. Definitions
For purposes of this Privacy Policy:
- “Company” means WING 8, LLC d/b/a WING 8 Pest Services, including its owners, officers, employees, contractors, affiliates, agents, successors, and assigns.
- “Customer” means any individual or entity that accesses our website, communicates with us, requests information, schedules Services, authorizes Services, or receives Services.
- “Services” means pest control, inspections, monitoring, subscriptions, equipment deployment, remediation, exclusion work, communications, and related offerings.
- “Personal Information” means information that identifies, relates to, describes, or could reasonably be linked to an individual or household.
- “Terms & Conditions” means the binding service agreement available at https://wing8pest.com/terms-conditions/.

2. Relationship to Terms & Conditions
This Privacy Policy describes data processing practices only.
All service rights, billing terms, cancellations, liability limitations, warranties, arbitration, and class action waivers are governed exclusively by the Terms & Conditions.
If you engage our services, or provide personal information in connection with requesting, scheduling, or receiving services, you agree that privacy-related claims arising from or relating to such interactions are subject to the arbitration and class action waiver provisions in the Terms & Conditions.
Regulatory Notice: Nothing in this Privacy Policy restricts an individual’s right to communicate directly with a regulatory authority or government agency regarding alleged violations of law.
In the event of any conflict concerning service rights or obligations, the Terms & Conditions control.
3. Data Minimization & Purpose Limitation
We collect only Personal Information reasonably necessary to:

We do not collect Personal Information for unrelated purposes.

4.3 Payment & Authorization Data
Payments are processed through Stripe and/or authorized processors. We may retain:
- Tokenized credentials
- Last four digits of payment instruments
- Authorization confirmations
- AVS/CVV verification indicators
- Account updater confirmations
- Transaction identifiers
We do not store full payment card numbers on Company servers.

4.5 Geolocation & Routing Data
- Approximate IP-based location
- Technician GPS routing logs
- Service verification location logs
GPS data may be retained for operational efficiency, technician safety, fraud prevention, service documentation, and dispute defense.
4.6 Audio Recordings & Electronic Communications
Calls may be recorded.
Recordings may be used for quality assurance, documentation, fraud prevention, chargeback defense, arbitration, or legal proceedings. AI-assisted transcription tools may process recordings.
We do not extract unique biological identifiers from voice data.
We do not use voiceprint or biometric voice identification technology.
4.7 Service Documentation & Imagery
We may capture photographs, environmental images, structural condition documentation, and thermal imagery scans. Such materials are used solely for pest detection and service documentation.
We do not use imagery for facial recognition, biometric identification, or medical analysis.
4.8 Fraud Prevention & Legal Defense Data
We may retain and process IP logs, device identifiers, GPS logs, service attempt documentation, communications history, and payment authorization metadata.
This data may be used to establish, exercise, or defend legal claims, including chargebacks, arbitration, and litigation.
4.9 Employee & Applicant Data
We collect employment-related information for hiring, payroll, compliance, safety, and operational management. Technician GPS logs and service documentation may be retained for operational integrity and safety compliance. Employee data is processed separately from consumer marketing data.
5. De-Identified & Aggregated Data
We may use aggregated or de-identified information that cannot reasonably identify an individual for analytics, research, operational improvement, or business purposes.
6. Legal Bases for Processing
We process Personal Information under:
- Performance of a contract
- Legitimate business interests
- Legal compliance
- Fraud prevention
- Consent (where required by law)
7. Artificial Intelligence & Automated Processing
We may use AI-assisted systems for call routing, transcription, scheduling, reminder messaging, and analytics.
We do not use fully automated systems to make legally significant decisions without human involvement.
AI communications do not modify contractual terms unless confirmed in writing by authorized personnel. We require contractual safeguards restricting AI vendors from using customer data to train public models without authorization.
8. SMS & Communication Consent
Marketing SMS communications are sent only where lawful consent is obtained. Reply “STOP” to opt out of marketing messages.
Service cancellations are governed exclusively by the Terms & Conditions and may not be effected via SMS or AI chat.
9. Cookies & Tracking Technologies
We use cookies for security, fraud detection, analytics, and advertising optimization. We honor Global Privacy Control (GPC) signals where legally required.
We do not sell personal information for monetary consideration and do not sell personal information of minors.
10. Data Retention
We retain Personal Information as reasonably necessary to:
- Perform Services
- Comply with legal obligations
- Enforce agreements
- Prevent fraud
- Defend disputes
- Establish, exercise, or defend legal claims
Inactive account data is typically retained approximately thirty-six (36) months, but may be retained longer where legally required or necessary for contractual defense.
11. Data Security
We implement reasonable safeguards including role-based access controls, encryption in transit (HTTPS/TLS), vendor confidentiality agreements, periodic security evaluations, incident response planning, and cyber liability insurance.
No method of transmission or storage is 100% secure.
Customers acknowledge data transmission occurs at their own risk to the extent permitted by law.
The Company’s data protection practices do not create duties beyond those legally required.
12. Limitation of Liability – Data Security
To the maximum extent permitted by law:
The Company shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from data processing or security incidents.
Total liability shall not exceed the greater of (a) $500; or (b) the amount paid by Customer in the six (6) months preceding the event.
13. Limitation Period for Claims
Any claim must be commenced within one (1) year after the earlier of the event or the date the claimant knew or should have known of the facts.
Negotiations do not toll this period unless agreed in writing.
14. Arbitration & Class Action Waiver
Privacy claims connected to services are subject to binding individual arbitration and class action waiver under the Terms & Conditions.
15. User Responsibility for Device Security
Users are responsible for securing their devices, credentials, and networks. The Company is not responsible for unauthorized access resulting from compromised credentials or insecure personal devices.
16. No Guarantee of Continuous Availability
The Company does not guarantee uninterrupted availability of systems, portals, or digital communications.
17. Force Majeure – Data Events
The Company is not liable for system interruptions or security events beyond reasonable control, including cyberattacks or infrastructure failures.
18. Publicly Disclosed Information
Information voluntarily made public by a user (e.g., social media posts or reviews) is not governed by this Privacy Policy once publicly disclosed.
19. Authorized Agents
We may require written authorization and identity verification before responding to requests submitted by authorized agents.
20. No Waiver
Failure to enforce any provision is not a waiver.
21. Severability
If any provision is unenforceable, it shall be modified to the maximum enforceable extent, and the remainder shall remain in effect.
22. Survival
Liability limitations, arbitration provisions, retention rights, and enforcement clauses survive termination.
